The Go-To Guide for DUI - Defense Defending DUIs - in Washington is Updated
For over ten years, Jon Scott Fox has co-authored Defending DUIs in Washington, the definitive and highly acclaimed treatise of DUI defense in Washington state that is used as a reference by other DUI defense attorneys. This year's edition, which was released in February, 2009, contains a number of revisions. According to Jon:
"This year's edition contains a number of updates that reflect the state of the art in DUI defense. The treatise will certainly prove to be a daily resource for attorneys seeking to provide the best representation for clients charged with DUI. This year, the chapter on the DataMaster breath testing machine was substantially revised and expanded. My intention in this chapter is to provide a broad-based reference that will be useful to the DUI defense attorney who is relatively new to the practice as well as the seasoned practitioner who wants to learn the scientific basis of breath testing as implemented in any breath testing device. I am fortunate to have had attorney/scientist Ted Vosk join in and co-author this chapter. Ted's extensive contributions to the DataMaster breath testing chapter have transformed it into the most comprehensive 'science of breath testing' chapter available in any DUI law treatise.
"My partner, Francisco Duarte, has written an entirely new chapter on a critical topic: Challenging Blood Tests. Most of the public, and many attorneys, feel that a blood test cannot be challenged in court and that the result must simply be accepted as accurate. As Francisco shows in the Blood Test chapter, a thoughtful approach to a blood test case can reveal a number of areas of challenge. This chapter is entirely written by Francisco and is the product of his years of experience with blood testing DUI and Vehicular Assault/Homicide cases.
"I have updated the chapter examining the procedures and issues related to 'drug recognition experts' (DRE) in the chapter on 'Drugged Driving.' The techniques used by a drug recognition expert are largely unknown to many DUI attorneys. For this year's edition of Defending DUIs in Washington, I expanded upon the 'Drug Recognition Experts' chapter that I wrote for previous editions of the book to provide additional references from throughout the United States which may be used in formulating a defense. Drugged DUIs are a growing phenomena in our country as law enforcement expands its dragnet: the notable arrests of celebrities Heather Locklear, Nicole Ritchie and Lindsey Lohan were all allegations of 'drugged DUI' or DRE cases.
"My co-author and I are, of course, ultimately responsible for the book Defending DUIs in Washington. But it must be acknowledged that others have contributed to the book, both in my firm, Fox Bowman Duarte, and in other firms. As is appropriately noted in the foreward to Defending DUIs in Washington, however, every partner in Fox Bowman Duarte has contributed to the book in one way or another. The end result is an excellent DUI defense manual and resource for any attorney who wishes to provide the best representation for a client charged with DUI."
